Terms of Service

1. Who we are

Xgen (xgenapp.org) is a service where a team of AI agents prepares marketing materials: posts, short videos, captions and reports. The service is operated by sole proprietor Ivan N. Chernykh, Sertolovo, Leningrad Region, Russia (the "Operator", "we"). Contact: [email protected].

2. Using Xgen

You must be at least 18 years old and able to enter into a contract.
You can connect your own TikTok and Instagram accounts to Xgen. You may connect only accounts that you own or are authorized to manage.
Xgen publishes videos and posts only to your own connected accounts and only on your command: you approve each publication in the Xgen dashboard or bot. Xgen never publishes anything on its own without your approval.
You can disconnect an account at any time on the Social page of your dashboard.

3. Your content

You are responsible for all content you create, approve and publish through Xgen, including content prepared by AI agents at your request. Review it before approving.
You keep all rights to your content. You grant us a limited license to process it and to send it to TikTok or Instagram on your command, only to provide the service.
You confirm that you have the rights to everything you publish (texts, images, video, music) and that it does not infringe the rights of others.

4. Platform rules and AI labels

You must follow the terms and community guidelines of TikTok and Instagram (Meta) for every account and every publication.
Content that is generated or significantly edited by AI must be labeled as such where the platform requires it. Use the AI-content label offered by TikTok and Instagram. Do not use Xgen to mislead people, impersonate others, or spread spam, hate, illegal or harmful content.

5. Suspension and termination

You can stop using Xgen and delete your data at any time (see our Data Deletion page).
We may suspend or end your access if you break these Terms or platform rules, misuse the service, or if the law or a platform requires it.

6. Disclaimer and limitation of liability

Xgen is provided "as is". AI-prepared materials may contain mistakes; we do not guarantee results, reach, followers or income.
TikTok and Instagram are independent services. We are not responsible for their availability, changes to their APIs, or decisions they make about your accounts or content.
To the extent permitted by law, our total liability for any claim is limited to the amount you paid us for the service in the three months before the claim, and we are not liable for indirect damages or lost profits.

7. Privacy

8. Changes and governing law

We may update these Terms; the current version is always at https://xgenapp.org/terms/. Continuing to use Xgen after a change means you accept it. These Terms are governed by the law of the Russian Federation; disputes are resolved by the competent court at the Operator's location, unless mandatory consumer law of your country says otherwise.
